Wage and hour issues under the Fair Labor Standards Act (FLSA) have become headline news. This past week, the U.S. Supreme Court elected not to hear an FLSA appeal from pharmaceutical giants, Novartis Pharmaceuticals Corp. and Merck & Co., based on a lower court’s decision that found pharmaceutical representatives to be non-exempt and, therefore, entitled to overtime despite the companies’ arguments that they were outside sales and/or administrative exempt.
