Employers with affirmative action plans that are subject to audit by the Office of Federal Contract Compliance (OFCCP) should be aware of a recent administrative law judge (ALJ) decision limiting the scope of such audits. A July 23, 2010 decision by ALJ Larry W. Price supported Frito-Lay in its refusal to submit transactional data that represented activity occurring after the date Frito-Lay received the Scheduling Letter for the audit.
